0. Scope
These terms apply to all transactions with Happy Trading SRL, operating under the commercial name Plant and Flower. They override any terms from the buyer unless otherwise agreed in writing.
1. Ordering and Payment
Orders are placed via the website www.plantandflower.be. Customers select products, confirm their cart, and complete payment through secure methods. Orders are considered final once payment is confirmed.
2. Delivery
Delivery is made on the agreed date unless affected by force majeure. Transport is handled by an approved carrier. Risk transfers upon delivery unless otherwise agreed.
3. Transfer of Ownership
Ownership transfers only after full payment. Until then, the buyer may not sell, modify, or transfer the goods.
4. Custom Products
For custom items, the buyer is responsible for the accuracy of provided measurements and must verify them on the order form.
5. Errors and Defects
In case of errors or defects, the buyer must notify us promptly. Visible defects must be reported within 48 hours of delivery. Hidden defects must be reported within two months of discovery.
6. Warranty and Liability
For professional buyers, liability is limited to replacement or repair. No additional compensation will be granted.
7. Cancellation and Refunds
To cancel an order, contact info@plantandflower.be. If accepted, refunds will be processed within 7 business days. No refunds for custom or perishable goods unless a defect is confirmed.
8. Payment and Penalties
Invoices are payable upon delivery. Late payments incur 10% monthly interest and a 10% penalty fee with a minimum of €20. All outstanding invoices become immediately due in case of default.
9. Disputes
Only Belgian courts have jurisdiction. Belgian law applies.
10. Data Protection
Personal data is used solely for invoicing. You may request access or correction by contacting info@plantandflower.be.
